Mediation Process
After appointing us to mediate a typical mediation will involve:
- Having Preparatory meetings with each party to discuss the arrangements for the Mediation.
- The Preparatory meetings may be in person or by telephone.
- Entering into an Agreement to Mediate – The Parties and the Mediator.
- Organising a venue with private rooms for each party.
- Exchanging documents that summarise the matter as seen by each party.
- Holding a Mediation Session which will normally be scheduled for a full day.
- Some Mediation Sessions are arranged over more than one day and this will be discussed with the Parties at the Preparatory meetings.
A typical Mediation Session will involve:
- The Mediator setting the procedure and chairing.
- Preliminary private meetings with each Party.
- The Parties and the Mediator meeting in joint session.
- Further exploratory meetings in private with the Parties.
- The Mediator checking with each Party anything that is a basis for moving the negotiation forward.
- The Mediation progressing with private and joint meetings as appropriate.
- The parties drawing up a settlement agreement with assistance of the Mediator.
