Mediation Process

After appointing us to mediate a typical mediation will involve:

  • Having Preparatory meetings with each party to discuss the arrangements for the Mediation.
  • The Preparatory meetings may be in person or by telephone.
  • Entering into an Agreement to Mediate – The Parties and the Mediator.
  • Organising a venue with private rooms for each party.
  • Exchanging documents that summarise the matter as seen by each party.
  • Holding a Mediation Session which will normally be scheduled for a full day.
  • Some Mediation Sessions are arranged over more than one day and this will be discussed with the Parties at the Preparatory meetings.

A typical Mediation Session will involve:

  • The Mediator setting the procedure and chairing.
  • Preliminary private meetings with each Party.
  • The Parties and the Mediator meeting in joint session.
  • Further exploratory meetings in private with the Parties.
  • The Mediator checking with each Party anything that is a basis for moving the negotiation forward.
  • The Mediation progressing with private and joint meetings as appropriate.
  • The parties drawing up a settlement agreement with assistance of the Mediator.
